Police arrived at the 1200 block of 15th St. Sunday morning after a Drake University student reported she had been sexually assaulted, according to a Des Moines police report.
There, police arrested 39-year-old Des Moines resident Luis Lopez on charges of 3rd Degree Sex Abuse.
The report stated that the 20-year-old junior was at the Dublin bar at 2307 University Ave. and became intoxicated.
“Victim does not remember anything until this morning when she awoke inside of the suspect’s vehicle with suspect on top of her,” according to the report.
Lopez was reportedly having sexual intercourse with the victim, who then started screaming. She was able to get out of the Lopez’s van and summon some people driving by for assistance.
Lopez left the scene, but returned after police arrived. He was taken into police custody and the victim was taken to the hospital.
Lopez is being held on $10,000 bond.
This is the second sexual assault reported by a Drake female student for the night of Nov. 14.

Another case of an underage Drake Student at the Dublin
November 16th, 2009 at 8:43 PM
How did a 39-year-old end up at Dublin bar?
Hellllo. No matter how intoxicated you are, you should not get into cars with random people you don’t know or just met. Obviously I feel horrible for this victim and don’t ever want someone to get hurt, but seriously people.
This should teach every student on this campus to use your head under any and all circumstances! If you can’t manage to do that, you probably should not be out partying it up anyways.

obviously didn’t happen at the Dublin. they never let 40 year-olds in. they only let in students. she must have left and gone to an after party or something and not remembered.

looks like Drake University and the TD are sure trying to paint the Dublin in a bad light. every time i’m there, i have a good time and things are ran pretty well. why blame the bar when you drink too much. why blame the bar when you present false identification to break the law, and why blame the bar when you get a ride from someone you don’t know. common sense says that Drake University is trying to blame the Dublin for everything. they need a scapegoat. they need a bad guy. it’s not even the underage thing. years ago, the legal age was 18. the problem is that there are bad people and they are everywhere. some i bet are even Drake faculty (sorry, but the law of averages says so). Blame the criminal, not a place where people go to shake off stress and to have a good time.
would you blame jimmy johns or paul revere’s pizza if the victim had stopped to get a bite to eat before getting in a van or going to another student’s apartment or the sigma chi house and getting assaulted?! wise up people…if you are blaming the bar, you’re prolly either a DU Employee waging war on the Dublin or Peggy’s trying to reclaim the business you lost when the Dublin came to town. think about it.

Old people have been at Dublin on many an occasion. I have witnessed this on several occasions. Probably why its gone downhill.
November 17th, 2009 at 12:11 AM
Students really shouldn’t be allowed in bars. First of all, it’s illegal to be drinking under the age of 21 and it’s also illegal to have a possession of a fake identification.
November 17th, 2009 at 12:24 AM
I like that one commenter says “how did a 39 year old end up at Dublin?”
Really?
The question SHOULD be: how did this 20 year old end up at Dublin?
Remember that whole drinking age thing?
Mark my words, with these 2 sexual assaults, plus the recent fraternity alcohol violations, Drake is going to start buckling down on alcohol, and im sure that will mean working with DMPD to crack down on minors in Drake bars.
November 17th, 2009 at 12:47 AM
Stop focusing on what age these girls were and start focusing on what happened to them. Drinking underage does not mean they deserved to be raped.
November 17th, 2009 at 1:05 AM
DMPD and Drake really have themselves in a tough pickle. On on hand, the underage bar system that has been in place for years is starting to be exposed to the entire city. Bad news
On the other hand, if they make the bars exclusively 21, underage people will wonder around campus looking for house parties – and that is not necessarily the safest thing to do. Going two, three, four blocks outside the bubble could prove very very dangerous in this neighborhood. We know that.
That is why the bar system is the way it is. If you think this press is bad, imagine the press that would occur if a student was stabbed, jumped, or God forbid, murdered, looking for a house party a couple blocks of campus.

Once again the police racially profile another brother and charge him with a crime that he didn’t commit. MLk fought so this wouldnt happen.

Personally, I’m just glad that these women have felt comfortable enough to report the sexual assault. So often, sexual assault goes unreported because of the way women who report it are treated. If these two incidents happened in just one night, think about the incidents happening every other night that go unreported, the assaulters who continue to do what they do. I hope the Des Moines police and Drake take this seriously.

This comment is for Drake Person
If you have been drugged, you are not coherent, it was not this girl’s choice to get in the car!

You people are missing the main issue here…
“would you blame jimmy johns or paul revere’s pizza if the victim had stopped to get a bite to eat before getting in a van or going to another student’s apartment or the sigma chi house and getting assaulted?!”
Listen, the Dublin is being mentioned because there has been a history of people being roofied there. Roofies are usually found in alcohol, not food so mentioning food establishments is pointless. the victim should NOT be blamed here and you should not be talking about how much people hate the Dublin. What needs to be addressed is she SEXUAL ASSAULT which people seem to be overlooking. Never blame the victim.
November 18th, 2009 at 1:06 AM
However, I think the sad part is that people do know that there have been history of people being roofied at parties and such and on a given night, it is very possible to be a victim of being roofied. I guess if the fact is out there and people still do, they don’t really believe that it’s true.
Look, people know the danger not only with the possible effects of alcohol, as a student earlier nearly died because of alcohol poisoning, but then also the use of drugs and being roofied. No one wants to be raped and especially not when you’re not in your right mind. But it’s not like we don’t let the students know about all these information. They sit and listen to it and then go out and party. If you know and truly believe that something is dangerous, you wouldn’t be even putting yourself in a situation that might make the event possible.

Living is dangerous. That doesn’t stop you from walking to your class or getting in your car and driving somewhere. If we live in fear, we aren’t living. It is regrettable that these actions were committed, but these women came forward, so hopefully things will get better and change so people can worry a little less about them.

Just a thought:
I’m a woman.
If I know that most rapes are facilitated with alcohol, should I NEVER drink?
If I know that most women are sexually assaulted by people they know, should I never trust men or have boyfriends?
ALL you are doing is blaming the victims for what happened to them. No one can live cloistered and avoid all danger. We all know that people drink and drive, but lord knows most of us still get in our cars and drive places.
Think about what you are saying and practice a little empathy. Rape isn’t the fault of the victim. It’s the rapist’s fault for doing the raping.
To those that have experienced sexual assault: I hope you get the help you need. Don’t let people who say these things (hopefully out of ignorance and not to be malicious) scare you into silence. IT WAS NOT YOUR FAULT. Try to believe that; I know it is hard. PLEASE get the help you need, and please don’t suffer alone. Remember, Stranger Danger is a lie. Most rapes are date-rapes or acquaintance rapes, and most are facilitated by drugs or alcohol.

Thanks for posting that Amanda.

Amanda that was right on the money. A lot has been said about these girls having known the dangers associated with underage drinking, even excusing the rapes as being an acceptable result because they shouldn’t have been drinking in the first place. The people who makes those types of ignorant statements show a blatant disregard for humanity and are downright despicable. Imagine if the brothers or sisters or mothers or fathers or friends of these girls are reading these comments. Imagine how sick to their stomachs they must feel while reading them. Imagine how you would feel if your girlfriend or best friend or daughter or wife was raped and you had to come read the same types of inexcusable comments blaming your loved one for a despicable crime committed against them. As a male, I hope I never have experience the pain of having a loved one have their lives and trust and happiness ripped away from them. I would hope people would step back and think before they pass judgments on these girls because you never know when you will be similarly affected by these types of horrific crimes.

In February of 2003 there was a fatal car accident near campus. Two students were killed and another was severly injured and barely survived. They had been drinking at Peggys, who’s insurance company paid large settlements to the families of the departed students. The incident did get some publicity but not as much Dublin has recently. It appears that the university has a grudge against Dublin and has since it opened. At what point is it harrasment? I sympathize with the victims and agree it’s not their fault, but where should the Blame be put? It should be placed on the perpatraitor and the the bussiness where they at some point? I think not! You are all intelligent people wise up!
